Foreclosure

Alabama is a “statutory foreclosure” state; meaning, foreclosure of a mortgage is effectuated by certain statutorily proscribed procedures without the necessity of filing a lawsuit. Hill, Hill & Gossett, P.C. has long represented lenders throughout Jefferson, St. Clair and the surrounding counties when it came time to foreclose on the real property collateral securing loans made by its clients.

Just as important as the correct technical procedures for foreclosing property, is the legal ability to represent lenders throughout the varied legal procedures both to reach the point where foreclosure can occur and to have persons legally removed from property once foreclosure has concluded. The attorneys at Hill, Hill & Gossett have years of experience in representing creditors in bankruptcy proceedings to secure “relief from stay” so as to secure the right to foreclose on property and in Ejectment procedures to secure a Court Order to have persons removed from property which has been foreclosed upon. Having the skill and experience to see the foreclosure process from inception to conclusion is imperative in the counsel a lender selects to represent them in foreclosure actions.

Hill, Hill & Gossett, P.C. takes pride in ensuring its clients receive superior service when it has been engaged by a creditor to foreclose. Because the process is set forth in statute, it can become tempting to go through the process without advising the client. Such a practice is unacceptable and unprofessional. Hill, Hill & Gossett, P.C. is committed to providing regular reports to its clients as to the status of their foreclosure files. Unlike larger firms which have more clients than can be serviced with personal / professional care, Hill, Hill & Gossett, P.C. requires that its paralegals and attorneys provide as much reporting to its clients as they desire. Satisfactorily completing a foreclosure is only partially the goal; maintaining and ensuring client trust and satisfaction is likewise of primary importance.

If you feel the level of service and attention offered by the attorneys of Hill, Hill & Gossett, P.C. would benefit you as a lender, we look forward to serving your needs in this area of law.
